Fleming Island Personal Injury & Family Law Attorneys

Fleming Island has become one of Clay County’s premier communities — a master-planned, family-rich area where residents have consistently faced a gap between the caliber of their community and the quality of legal representation available to them locally. Phillips Hunt Whited closes that gap. We serve Fleming Island residents with the same Forbes Top 200 personal injury practice and Florida Bar Board Certified family law that we bring to clients across Northeast Florida.

Our founding partner John Phillips has recovered more than $495 million in verdicts and settlements and is ranked among the Forbes Top 200 Personal Injury Attorneys in the United States for 2025. Our family law partner Matt Hunt is Board Certified in Marital and Family Law by the Florida Bar — a credential held by fewer than one percent of Florida attorneys and by no attorney competing for Fleming Island family law clients in this market.

We advance all costs on personal injury cases. You owe nothing unless we win. We do not charge clients for copies or document fees at the conclusion of your case.

Personal Injury in Fleming Island and Southern Clay County

US-17 is the primary artery connecting Fleming Island to the rest of Clay County and to Jacksonville — and one of the most dangerous roads in the 4th Judicial Circuit. The intersection clusters at US-17 and Fleming Island’s major collector roads carry heavy commuter traffic in both directions during peak hours. The rapid residential growth of the Fleming Island Plantation and surrounding developments has multiplied vehicle trips on a road network that was not originally designed for this volume.

Motor Vehicle Accidents — Crashes on US-17, Town Center Boulevard, and the surrounding Fleming Island road network frequently involve rear-end collisions in stop-and-go traffic and intersection crashes at poorly timed signals. Florida’s no-fault PIP system covers initial medical expenses and lost wages up to $10,000, but serious injuries routinely exhaust those limits. We then pursue full recovery through the at-fault driver’s liability coverage and your own underinsured motorist policy.

Commercial Truck Accidents — US-17 carries commercial traffic between Orange Park, Green Cove Springs, and Palatka year-round. Crashes involving commercial vehicles trigger federal and state regulatory analysis — driver qualification files, hours-of-service logs, inspection records, and cargo documentation — and may involve multiple defendants. We preserve evidence immediately and build these cases for maximum recovery.

Motorcycle Accidents — US-17 is a popular motorcycle corridor through Clay County. When a motorcyclist is injured by a negligent driver, the injuries are often severe and the legal dispute can be contentious, with insurers looking for comparative fault arguments. We represent injured motorcyclists throughout the 4th Judicial Circuit.

Bicycle and Pedestrian Accidents — Fleming Island’s planned community character means more residents on foot and on bikes — often in proximity to high-speed vehicle traffic. When an injury occurs, the damages are frequently catastrophic. We handle these cases with the expert reconstruction and medical analysis they require.

Wrongful Death — If someone in your family was killed due to another’s negligence in Clay County, Florida’s Wrongful Death Act (§ 768.19, Fla. Stat.) allows the estate’s personal representative to pursue recovery for surviving family members. Call us before speaking with any insurance company.

Premises Liability — The commercial development surrounding Fleming Island’s Town Center and surrounding retail corridors creates standard premises liability exposure. Slip and fall, inadequate maintenance, and security failures on commercial property can produce serious, compensable injuries.

Clay County Courts

Fleming Island is in Clay County, and its residents’ civil and family law matters are handled in the Clay County Courthouse in Green Cove Springs. Clay County is in Florida’s 4th Judicial Circuit, along with Duval and Nassau counties. We have litigated cases in this circuit and know the courts, the procedures, and the judges. Our trial record is real — and it is what produces genuine settlement leverage.

Family Law for Fleming Island: Board Certified Representation

Fleming Island’s family demographics — many dual-income households, growing families, and long-term established residents — generate a consistent range of family law needs. Whether you are navigating an initial divorce, a custody dispute, a post-decree modification, or a support enforcement matter, the credentials of your family law attorney determine the outcome.

Matt Hunt is Board Certified in Marital and Family Law by the Florida Bar. Board Certification requires years of concentrated practice, a written examination, peer review for professionalism and competence, and demonstrated substantial involvement in the specialty. It is the Florida Bar’s highest formal recognition of legal competence in a specialty area. Matt is AV-Preeminent rated and recognized on the Florida Super Lawyers list. He is among the youngest attorneys in Florida to have earned this certification in family law.

No attorney at any firm competing for Fleming Island family law clients holds this credential.

Divorce — Florida’s no-fault dissolution statute (§ 61.052, Fla. Stat.) requires only that the marriage be irretrievably broken. Contested divorces are decided on three sets of issues: equitable distribution of marital assets and debts (§ 61.075), timesharing and parental responsibility (§ 61.13), and alimony (§ 61.08). We litigate all three with the specificity that contested family law requires.

Timesharing and Parental Responsibility — Florida’s 2023 reform created a presumption of equal (50/50) timesharing under § 61.13. Both parents begin from an equal starting point, and departure from equal timesharing must be supported by evidence addressing the statutory best-interest factors. Matt Hunt builds the factual record that determines the outcome in contested timesharing cases.

Alimony — The 2023 overhaul of Florida alimony law (HB 1409, effective July 1, 2023) eliminated permanent alimony and imposed durational caps tied to marriage length. For Fleming Island couples with income disparities, the alimony analysis under the new framework is the financial core of the divorce. We get it right.

Child Support — Florida’s income shares model under § 61.30 calculates child support from both parents’ combined net income. Significant timesharing (73+ overnights per year with the non-residential parent) can reduce the guideline obligation. Disputes over income, imputed income, and the proper treatment of bonuses and self-employment income are common — and consequential.

High-Asset Dissolution — Some Fleming Island residents have complex marital estates: business ownership, pension plans and 401(k)s requiring QDROs, investment real estate, and deferred executive compensation. We work with Florida’s best financial and business valuation experts to ensure the marital estate is properly identified, valued, and divided.

Modification — Life changes after a final judgment. When the change is substantial, material, and unanticipated, you may petition for modification of timesharing, child support, or alimony. The 2023 reform created new grounds for alimony modification based on a payor’s retirement. Matt Hunt evaluates modification cases honestly and only takes matters that meet the legal threshold.

Frequently Asked Questions: Fleming Island and Clay County

What is the statute of limitations for a car accident injury claim in Florida?
Two years from the date of injury under § 95.11(4)(a), Fla. Stat., following the change that took effect in 2023. Wrongful death claims also have a two-year limitation period. Missing the deadline extinguishes your right to sue regardless of the merits of your case. Do not delay.

I was hit by a driver who only had property damage insurance. What are my options?
Florida does not require drivers to carry bodily injury liability insurance. If the at-fault driver has no BI coverage, your primary recovery avenue is your own uninsured motorist (UM) policy. We evaluate every potential defendant in the case, including vehicle owners, employers (if the driver was on duty), and other third parties.

Can I relocate with my children after the divorce is final?
Not without following the requirements of § 61.13001, Fla. Stat. Any relocation more than 50 miles from your current principal residence requires either a written agreement with the other parent or court approval. Relocating without following this procedure is grounds for the court to order the child’s return and can result in modification of timesharing in the other parent’s favor.

My former spouse stopped paying child support. What can I do?
Florida courts have significant enforcement tools for child support non-compliance: income deduction orders (wage garnishment), contempt of court (including incarceration), driver’s license suspension, professional license suspension, and interception of federal tax refunds. We pursue enforcement aggressively when a paying parent fails to comply.

What is a QDRO and why does it matter in my divorce?
A Qualified Domestic Relations Order is a court order that divides a retirement account — a 401(k), 403(b), or pension plan — between divorcing spouses without triggering early withdrawal taxes or penalties. A poorly drafted QDRO can cost thousands of dollars in lost benefits or unexpected taxes. We work with QDRO specialists to ensure the order is done correctly.
